Domestic abuse is physical, and sometimes psychological, harm inflicted on a member of a household by another member of the same household. This occurs most often between spouses or domestic partners.

Orders of Protection (Restraining Orders)

A common procedure in a domestic violence case is to issue an order of protection, also known as a restraining order. You must fight an order of protection if one is issued against you, because it has an immediate affect on your life. An order of protection can:

  • Prohibit any contact with the accuser
  • Order you to move out of your shared home
  • Order you to maintain a distance of at least 100 yards from the accuser, her (or his) home and work
  • Order you to attend counseling
  • Prohibit you from buying a gun
    • An order of protection can also include protection for children and other people living in the home.

      Violating a Protective Order
